La construction communautaire en Afrique, saisie par le juge, constitue une véritable avancée. La mise en place de cours de justice a imprimé aux organisations d'intégration africaine (CAE, CEDEAO, CEMAC, COMESA, SADC, UEMOA) une nouvelle physionomie marquée par le respect du droit et de la légalité. Ces juridictions sont conçues pour accompagner les processus communautaires en contribuant à l'élimination des entraves aux objectifs d'intégration. Par le biais de leurs jurisprudences, caractérisées par une prééminence de la protection des droits de l'homme et une indigence du contentieux des libertés économiques, les cours de justice africaines, assument une mission de « gardiennes des objectifs d'intégration». |
