Summary, etc Contrairement à d'autres traités internationaux de protection des droits fondamentaux, la Convention européenne des droits de l'homme protège les personnes privées de liberté exclusivement contre les détentions arbitraires (article 5). Nonobstant cette lacune textuelle, les personnes privées de liberté jouissent au sein du système conventionnel d'une protection effective de leurs droits fondamentaux. D'origine prétorienne, cette protection des droits substantiels et procéduraux a su s'imposer au sein des États membres du Conseil de l'Europe comme un véritable "droit commun européen de la détention". Révélateur de l'important pouvoir normatif dont dispose le juge européen, cette norme prétorienne de protection des droits des détenus contribue à compléter et à améliorer leur protection juridique au sein du Conseil de l'Europe.
