Summary, etc La réflexion sur le « fait constaté » devant le Comité des droits de l'homme des Nations Unies constitue une contribution à la théorie de l'expertise internationale. Son analyse révèle non pas une question litigieuse, débattue de manière contradictoire ou véritablement tranchée, mais plutôt un problème de conventionnalité des actes des États parties au Pacte international relatif aux droits civils et politiques. Le critère du « fait constaté » découle de l'observation par des experts des droits de l'homme du manquement à l'observation ou à l'exécution des obligations conventionnelles d'un État partie. Cette observation résulte de l'expertise juridique et pratique des membres du Comité et du Rapporteur spécial. Élus par l'un et nommés par l'autre, ils ont pour mission d'examiner les violations des droits civils et politiques et de surveiller la mise en œuvre des conclusions du Comité. C'est pourquoi le suivi de la mise en œuvre du Pacte international relatif aux droits civils et politiques relève de la compétence exclusive des experts des droits de l'homme.
