Summary, etc Le pr�esent livre se veut tout �a la fois un commentaire lin�eaire d'un texte peu �etudi�e en droit, le pacte international relatif aux droits �economiques, sociaux et culturels, et une r�eflexion sur les caract�eristiques d'une soci�et�e dans laquelle les droits de l'homme constituent une valeur cardinale et une norme contentieuse essentielle. �A travers cette double approche, l'ouvrage souligne les ambigu�it�es des textes relatifs aux droits de l'homme qui peuvent servir �a tout justifier, mais �egalement les limites juridiques d'un discours politique comme celui relatif �a l'adoption des ordonnances en droit du travail qui ignore le cadre juridique dans lequel il est prononc�e. En filigrane, l'ouvrage dresse le portrait d'une soci�et�e de diff�erend dans laquelle la norme p�enale a vocation �a jouer un r�ole pr�edominant et les accommodements raisonnables une nouvelle norme d'appr�eciation des comportements.
