Summary, etc La 4ème de couverture indique : "Les droits de l'homme n'ont pas déplacé ni éliminé la souveraineté des Etats, mais ils l'ont limitée et relativisée. Cependant, la protection effective des droits de l'homme nécessite l'intervention des pouvoirs publics, à c'est-à-dire des Etats. Paradoxalement, si les Etats ont des obligations négatives de ne pas interférer dans l'exercice des droits et libertés, ils ont aussi des obligations positives de deux types. D'une part, ils doivent créer les conditions nécessaires pour que ces droits soient effectifs et pas seulement théoriques ; d'autre part, ils doivent réagir face aux violations graves et massives des droits fondamentaux de l'homme. Il s'agit de crimes contre la communauté internationale et concernent donc l'ensemble de l'humanité. Il pourrait donc surprendre qu'un ouvrage sur la protection internationale des droits de l'homme réaffirme et souligne les fonctions propres des Etats. Mais, face à la thèse de la crise de l'Etat, cet ouvrage met en valeur que la tension entre la souveraineté et les droits de l'homme peut être dépassée par la notion des obligations positives des Etats. Ces dernières leur sont imposées par le droit international contemporain en vue d'atteindre la promotion et la protection effective de la dignité propre à tout être humain."
